In the business, there are lots of activities, situations where the decision of right and wrong is important. Having defined business ethics in terms of issues of right and wrong, one might quite naturally question whether this is in any way distinct from the law. Surely, the law is also about issues of right and wrong? This is true, and there is indeed considerable overlap between ethics and the law. In fact, the law is essentially an institutionalization or codification of ethics into specific social rules, regulations, and proscriptions.
Nevertheless, the two are not equivalent. Perhaps the best way of thinking about ethics and the law is in terms of two intersecting domains (see Figure). The law might be said to be a definition of the minimum acceptable standards of behavior. However, many morally contestable issues, whether in business or elsewhere, are not explicitly covered by the law.
Ethics is all-pervading in human life. Any human being, no matter which walks of life he comes from, their actions tend to have ethical implications, be he a politician, a businessman, a government official or a big corporate company, they are bound to face situations where they have to take decisions and those decisions have a strong ethical aspect to them.
One of the most important theories in the history of ethics was propounded by German philosopher Immanuel Kant. According to Kantian ethics, a human being must always be treated as an end and not as a means in the sense that a human being ought never to be used by another human being for any purpose whatsoever. This is one of the foundational principles of Kantian ethics.
In the case of businesses, be it at the manufacturing level, or at the marketing level or at the level of human resources, the human dignity and the intrinsic value of being human if not taken into account in the decision-making process, the decisions are susceptible to be ethically questionable.
